European Electronic Communications Code

This European Electronic Communications Code Addendum (“EECC Addendum”) applies to users located in the European Union, the European Economic Area (EEA), and the United Kingdom who use XMReality’s interpersonal communications services (such as video, audio, and chat features within the XMReality Remote Guidance platform).

This Addendum supplements and forms part of the XMReality Terms and Conditions (EULA), available at https://www.xmreality.com/legal/eula. In the event of any conflict between the EULA and this EECC Addendum, the terms of this Addendum shall prevail regarding your rights under the EECC.

1. Scope and Eligibility

The rights described in this Addendum apply to "Consumers," "Microenterprises," "Small Enterprises," and "Not-for-Profit Organizations," as defined under the EECC and relevant national laws, unless such entities have explicitly waived these rights where permitted.

2. Service Information and Quality

XMReality provides a remote guidance solution that includes real-time communication features.

Service Levels: Details regarding the specific service features, technical requirements, and any applicable service level commitments are outlined in your specific subscription plan and the XMReality EULA
Quality of Service: While XMReality strives to provide high-quality video and audio transmission, the quality of the service may be affected by factors outside of our control, including your local internet connection, bandwidth, and hardware compatibility.

3. Emergency Services (Important Disclosure)

XMReality’s communication features are Number-Independent Interpersonal Communications Services (NI-ICS).

No Access to Emergency Services: Unlike traditional telephone services, XMReality does not provide access to emergency services (such as 112 or 999). You cannot use XMReality to make calls to emergency responders.
Alternative Means: You must ensure that you have alternative means of contacting emergency services (e.g., a mobile or fixed-line telephone).

4. Security and Data Protection

At XMReality, we take the security of our platform and the protection of your data with the utmost seriousness.

ISO 27001 Certified: To demonstrate our commitment to the highest security standards, XMReality is ISO 27001 certified. This international certification ensures that we have established, implemented, and maintained a robust Information Security Management System (ISMS) to protect your information.
Security Measures: We implement rigorous technical and organizational measures to protect the platform against security incidents, unauthorized access, and emerging threats.

5. Contract Duration, Renewal, and Termination

The duration of your contract, renewal terms, and termination rights are governed by the XMReality EULA and your specific Service Agreement.

Summary of Rights: Before being bound by a contract, eligible users are entitled to receive a concise contract summary (where applicable under local law).
Modifications: If XMReality proposes changes to the contract that are not exclusively to the benefit of the user, are purely administrative, or are required by law, eligible users may have the right to terminate the contract without penalty.

6. Dispute Resolution

If you have a complaint regarding the service, please contact us. If we are unable to resolve the dispute internally:

You may be entitled to refer the matter to an independent alternative dispute resolution (ADR) body in your country of residence.
